Welcome to loveneon.com.au. This website is owned and operated by loveneon.com.au. By visiting our website and accessing the information, resources, services, products, and tools we provide you understand and agree to accept and adhere to the following Terms and Conditions.
By submitting an order to Love Neon (“The Company”), you (The Client”) agree to our Terms and Conditions and you are entering a binding contract.
This agreement is in effect as of Jul 23, 2020.
Terms of Agreement
– These Terms and Conditions cover all Contracts entered into by the Client with the Company for services relating to the custom design, (“Products”).
Customer Agreement
– The Client accepts that a custom quote generated by our website www.loveneon.com.au relies on the correct information supplied by the client. On receipt of your order we will check your quote submission and notify you if any corrections need to be made to your order. In the event that a price correction has been applied, The Client can choose to accept the price correction or cancel their order. On accepting the price correction, The Client must finalise payment terms before we commence production on the Product.
– Price corrections may be the result of (but not limited to):
(1) Incorrect number of total characters entered in the quote form.
(2) Incorrect number of uppercase characters entered in the quote form.
(3) Design limitations that require a modification to the design.
(4) Where The Client has selected “Other” Font Family and wishes to use a custom font not listed in our selection of fonts, then the chosen font will be manually reviewed and subject to price correction.
(5) Our prices are updated weekly, any quotes received more than 14 days before processing payment may be subject to price correction.
– The Client understands that Products will not be ordered until the The Client has finalised payment terms and made the first payment.
– The Client can cancel the order at anytime before production of the Product has commenced. If the order is cancelled, The Company will refund The Client for any funds received in payment for the Product.
– Products are handmade and subject to variations. The client acknowledges that there may be small glue marks on the acrylic. These marks are unlikely to be visible when the light is on. Some variations in colour can also occur as a result of computer screens. By accepting these terms you are recognising that these variations are not the Companies fault.
Refunds and Returns
– Custom signs are not eligible for refund.
– Faulty signs may be returned for refund. The Client must contact the Company within 48 hours to organise a return. Date stamped photographic proof is to be submitted with details of the fault.
– All refunds will be processed but will not be inclusive any fees that may have been applicable at time of purchase.
Payment Plans
– Products paid by instalments are shipped for delivery between 4-6 weeks. Late or failed payments will result in your Product being held back until payment is received.
Warranty
– Love Neon Products come with a 12 manufacturer warranty for standard signs, and 6 month manufacturer warranty for waterproofed signs when used in accordance with accompanying instructions.
– The Warranty does not cover general wear and tear or damage as a result of misuse of the Products.
– Faults must be manufacturing faults only and are not inclusive of aesthetic damage.
Limitation of Liability
– In conjunction with Warranties as explained above, you expressly understand and agree that any claim against us shall be limited to the amount you paid, if any, for use of Products. loveneon.com.au will not be liable for any direct, indirect, incidental, consequential or exemplary loss or damages which may be incurred by you as a result of using our Products, or as a result of any changes, data loss or corruption, cancellation, loss of access, or downtime to the full extent that applicable limitation of liability laws apply.
Usage
– The Company reserves the right to use photographs of the Products for the purposes of marketing.
– The Client is responsible for ensuring that their Custom Order Designs are not in violation of any intellectual property rights. The Company will not be held responsible for any intellectual property infringements for any designs created for The Client.
Shipping
– The Company will not be liable for any direct, indirect, incidental, consequential or exemplary loss or damages caused by circumstances outside of reasonable control, such as but not limited to, strikes, government restrictions, transport delays, theft or weather.
– Estimated shipping time on all order is 4-6 weeks from receipt of payment by the Client.
Privacy
– Your privacy is very important to us, which is why we’ve created a separate Privacy Policy in order to explain in detail how we collect, manage, process, secure, and store your private information. Termination of Use
– You agree that we may, at our sole discretion, suspend or terminate your access to all or part of our website and Resources with or without notice and for any reason, including, without limitation, breach of this User Agreement. Any suspected illegal, fraudulent or abusive activity may be grounds for terminating your relationship and may be referred to appropriate law enforcement authorities. Upon suspension or termination, your right to use the Resources we provide will immediately cease, and we reserve the right to remove or delete any information that you may have on file with us, including any account or login information.
Governing Law
– This website is controlled by loveneon.com.au from our offices located in the state of NSW, Australia. It can be accessed by most countries around the world. As each country has laws that may differ from those of NSW, by accessing our website, you agree that the statutes and laws of NSW, without regard to the conflict of laws and the United Nations Convention on the International Sales of Goods, will apply to all matters relating to the use of this website and the purchase of any products or services through this site.Furthermore, any action to enforce this User Agreement shall be brought in the federal or state courts located in Australia, NSW You hereby agree to personal jurisdiction by such courts, and waive any jurisdictional, venue, or inconvenient forum objections to such courts
